Terms of Service

Acceptance of Terms

By creating a SwiftLead account or using any part of our service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not create an account or use the service.

These terms constitute a legally binding agreement between you and SwiftLead. You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of your business.

Description of Service

SwiftLead provides an automated missed call recovery platform that sends AI-powered SMS responses to missed callers on behalf of local service businesses.

The service includes:

  • A dedicated local phone number for your business
  • Automated SMS follow-up within 60 seconds of a missed call
  • AI-powered conversation handling to qualify leads
  • A lead management dashboard with full conversation history
  • Analytics and performance reporting

Account Registration

You must provide accurate, complete, and current business information when creating your account. Providing false information is grounds for immediate termination.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

The Starter and Pro plans allow one business location per account. The Agency plan allows up to five business locations.

Acceptable Use

You agree NOT to use SwiftLead to:

  • Send spam, unsolicited messages, or bulk SMS to numbers that have not called your business
  • Impersonate other businesses, individuals, or entities
  • Violate any applicable SMS marketing laws including TCPA and CAN-SPAM
  • Use the service for any illegal, fraudulent, or harmful purpose
  • Attempt to reverse engineer, copy, or create derivative works of the platform
  • Interfere with or disrupt the integrity or performance of the service
  • Circumvent any security or access control measures

SMS Compliance

You are solely responsible for ensuring your use of SwiftLead complies with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all other applicable federal, state, and local regulations governing SMS communications.

SwiftLead sends SMS messages only to phone numbers that have initiated contact by calling your business number. This inbound-initiated model is designed to comply with TCPA requirements, but compliance remains your responsibility.

You must not use SwiftLead to send unsolicited bulk SMS or to contact individuals who have opted out of communications from your business.

Subscription & Billing

Subscriptions are billed monthly through Lemon Squeezy. A 14-day free trial is offered on all plans — your payment method will not be charged until the trial period ends.

Subscriptions automatically renew monthly unless cancelled before the renewal date. You can cancel at any time from your Billing page — access continues until the end of the current billing period.

We do not offer refunds on partial months. If you cancel mid-cycle, you retain access until the period ends.

Prices may change with 30 days' notice to existing subscribers. Continued use after a price change constitutes acceptance of the new pricing.

Service Availability

We target 99.5% uptime but do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance where possible.

SwiftLead relies on third-party services including Twilio, Supabase, and Google. We are not liable for downtime or service degradation caused by these providers.

Intellectual Property

SwiftLead owns all rights, title, and interest in and to the platform, including all software, code, design, trademarks, and brand assets.

You retain full ownership of your business data and conversation logs. By using SwiftLead, you grant us a limited, non-exclusive license to process your data solely to deliver the service.

Limitation of Liability

To the maximum extent permitted by law, SwiftLead is not liable for:

  • Lost leads or revenue during service downtime
  • AI-generated responses that are inaccurate, incomplete, or inappropriate
  • Third-party service failures (Twilio, Google, Supabase, Lemon Squeezy)
  • Any indirect, incidental, special, or consequential damages

Our total aggregate liability is limited to the amount you paid to SwiftLead in the three months preceding the claim.

Termination

You may cancel your account at any time from the Billing page. No questions asked.

We reserve the right to suspend or terminate accounts that violate these Terms of Service, without prior notice.

Upon termination, your data is retained for 30 days to allow for reactivation, then permanently deleted.

Governing Law

These Terms are governed by applicable law. Any disputes will first be addressed through good-faith negotiation between the parties. If negotiation fails, disputes will be resolved through binding arbitration.

Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email at least 14 days before they take effect. The updated terms will be posted on this page with a revised effective date.

Continued use of SwiftLead after changes take effect constitutes acceptance of the updated terms.
